Argentina To Lose GSP Duty Reduction Benefits

US Customs & Border Protection has announced  that due to a recent Presidential Proclamation, Argentina will lose their GSP eligibility effective May 28, 2012. The loss of GSP benefits will mean many goods of Argentina origin that were entering the U.S. duty free will now be subject to full duties. This could have a significant impact for importers of these goods.

US Customs Centers for Excellence and Expertise

US Customs & Border Protection has announced they will be opening their third and fourth “Centers of Excellence and Expertise” (CEE) in the very near future. With the addition of these two new CEE, Customs will have the following CEE offices in operation:

  • Long Beach, CA – Consumer Electronics CEE
  • New York, NY – Pharmaceuticals CEE
  • Detroit, MI – Automobile and Aerospace CEE
  • Houston, TX – Petroleum, Natural Gas and Minerals CEE
CEE offices are established by Customs to provide the following services to their specific industries:
  • Technical guidance regarding imports
  • Clarification of Customs policies and procedures
  • Assistance with Customs requests for information and notices of action
  • Information regarding counterfeit/substandard imports
Customs further intends that the CEE offices are able to help ensure that imported products are classified and treated consistently at all US ports of entry.

Annual Notice of Duty Payment

U.S. Customs requires all customs brokers to provide the following notice to our customers annually:

“If you are the importer of record, payment to the broker will not relieve you of liability for customs charges (duties, taxes, or other debts owed CBP) in the event the charges are not paid by the broker. Therefore, if you pay by check, customs charges may be paid with a separate check payable to the “U.S. Customs and Border Protection” which will be delivered to CBP by the broker.”

Any customer who wishes to make duty payments directly to US CBP must advise us in advance so this procedure can be set up and so that the timely payment of duty can be ensured.

ISF Penalties On The Horizon?

Though there is no news release yet, it appears that Customs is getting closer to moving the ISF program into full compliance mode. Once this occurs importers could be subject to penalties of up to $5,000 per shipment for failure to file ISF on time. Now is a critical time for all importers to review their ISF filing program to ensure it is compliant.
